Welcome to Vitera. These Terms of Service ("Terms") apply to your access to and use of the Vitera website, account system, resume diagnosis flow, AI-assisted optimization features, template selection features, export features, and related services (collectively, the "Service").
By accessing or using the Service, creating an account, or completing a purchase, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Eligibility and Acceptance of Terms
You may use the Service only if you have the legal capacity to enter into a binding agreement in your jurisdiction.
If you use the Service on behalf of an organization, you represent and warrant that you have authority to accept these Terms on that organization's behalf and to bind that organization to them.
2. What the Service Provides
Vitera is an online service that helps users:
- upload or paste resume content;
- submit a target job description and related background information;
- receive structured resume assessment feedback;
- generate AI-assisted resume optimization content based on the user's real information;
- choose a template and export a final resume version; and
- manage Complete Resume Optimization Flows and in-progress role-specific versions in the workspace Dashboard.
The purpose of the Service is to help users prepare a stronger resume for a specific role. The Service is not a recruiter, employer, job board, legal advisor, immigration advisor, or professional licensing advisor.
3. Accounts and Sign-In
You may need an account to access some or all features of the Service. In the current version, sign-in may be provided through third-party authentication providers such as Google or GitHub.
You are responsible for:
- safeguarding access to your account;
- providing accurate and up-to-date account information;
- all activity that occurs under your account; and
- notifying us promptly if you believe your account has been accessed without authorization.
If we reasonably believe that an account violates these Terms, presents a fraud risk, or creates a security or operational risk, we may restrict or suspend access to that account.
4. Your Content
You may submit resumes, job descriptions, notes, factual additions, and other materials to the Service (collectively, "User Content").
You retain ownership of your User Content. These Terms do not transfer ownership of User Content to Vitera.
You grant Vitera a limited, non-exclusive, worldwide license to host, store, copy, process, format, adapt, and display your User Content to the extent necessary to provide the Service, including to:
- operate the Service;
- generate resume diagnosis results and AI-assisted optimization content;
- save your in-progress and completed versions;
- provide customer support; and
- improve service stability and security.
When your User Content is deleted from the Service, this license generally ends. However, we may retain relevant content to the extent necessary for legal compliance, dispute resolution, fraud prevention, security, backup integrity, or other reasonable operational purposes described in our Privacy Policy.
5. Accuracy and Upload Rights
You are responsible for the truthfulness, legality, and accuracy of the information you submit.
You agree not to:
- submit content you do not have the right to use;
- ask the Service to fabricate, falsify, or materially misrepresent your work history, education, credentials, or results;
- upload unlawful, defamatory, infringing, malicious, abusive, or otherwise improper content;
- upload malicious code, exploit code, or content intended to interfere with the Service; or
- submit highly sensitive personal information unless it is truly necessary.
Vitera is designed to help you express your real experience more clearly and make it more relevant to a role, not to help you invent experience or create misleading job application materials.
6. Permitted Use and Prohibited Use
You may use the Service only for lawful purposes and in accordance with these Terms.
You may not:
- interfere with or disrupt the Service;
- attempt unauthorized access to the Service or related systems;
- systematically extract content from the Service through scraping, mirroring, bulk extraction, or similar means, except where clearly permitted by law;
- reverse engineer, decompile, or attempt to discover the source code, underlying logic, or models of the Service, except where restrictions on such activity are prohibited by law;
- use the Service in violation of applicable law to build a competing product, dataset, or substitute service;
- use automation to register accounts in bulk or abuse product quotas; or
- use the Service in a way that may harm other users, Vitera, or third parties.
7. Products, Orders, and Billing
Vitera may offer one-time digital purchase units, such as Complete Resume Optimization Flows. Each flow may include one resume assessment and one resume optimization unless the checkout page states otherwise. Their specific scope, quantity, pricing, currency, and usage conditions are governed by what is displayed on the checkout page or the relevant product interface.
You agree to pay the full amount shown at checkout, including applicable taxes. Payments may be processed by third-party payment providers. We are not responsible for errors caused solely by payment providers, card networks, banks, or other financial institutions, but we will reasonably assist you in reviewing legitimate issues.
After a product action such as purchase, redemption, activation, or another trigger for performance is completed, paid features may begin to be provided immediately.
8. AI-Assisted Output and User Responsibility
The Service may use AI-assisted systems to generate suggestions, rewrites, structural recommendations, and other output.
You understand and agree that:
- AI-generated or AI-assisted output may be incomplete, inaccurate, or unsuitable for your specific situation;
- you are responsible for reviewing, checking, and confirming any resume content you ultimately use;
- Vitera does not guarantee that any output will be error-free or suitable for any employer, role, or jurisdiction; and
- Vitera does not guarantee that you will receive an interview, offer, salary outcome, visa outcome, or any employment outcome.
9. Intellectual Property
Except for User Content, the Service and its software, workflows, interface design, brand assets, templates, visual assets, and other content are owned by Vitera or its licensors and are protected by applicable intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-transferable, non-exclusive, revocable license to use the Service for personal or internal job application purposes.
You may not use Vitera trademarks, logos, or other brand identifiers without our prior written permission.
10. Service Availability and Changes
We may change, improve, limit, or discontinue any part of the Service at any time. We may also adjust product structure, feature availability, supported sign-in methods, product flows, quota rules, or interface details.
We do not guarantee that the Service will always be available, uninterrupted, absolutely secure, or error-free.
11. Suspension and Termination
We may suspend or terminate your access to all or part of the Service if:
- you violate these Terms;
- your use creates legal, security, operational, or reputational risk;
- we reasonably suspect fraud, abuse, or unauthorized access; or
- we are required to do so by law.
You may also stop using the Service at any time.
12. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. Vitera disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and continuous availability.
Nothing in these Terms excludes any warranty or statutory right that cannot be excluded under applicable law.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Vitera and its affiliates, service providers, licensors, and representatives will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or anticipated savings.
To the maximum extent permitted by applicable law, Vitera's total cumulative liability arising out of or relating to the Service will not exceed the greater of:
- the amount you actually paid to Vitera for the paid feature or product giving rise to the dispute during the 12 months before the dispute arose; or
- USD 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rules.
14. Governing Law and Consumer Rights
These Terms are governed by the laws of the jurisdiction in which Vitera's operating entity is established, without regard to conflict-of-law rules.
If you are a consumer, you may also have mandatory protections under the laws of your place of residence. Nothing in these Terms removes any mandatory consumer rights you have under applicable law.
15. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will post the updated version on this page and update the "Last Updated" date above. Where required by law, we will also provide additional notice.
Your continued use of the Service after the updated Terms take effect means that you accept the updated Terms.
